Mandatory Insurance for Baja

Mandatory Auto Insurance in Baja 2024

Several years ago, on January 1st 2012, Baja California (Norte) began enforcing a mandatory law requiring at least a liability-only insurance policy while traveling in the state. All vehicles in Baja California (Norte) - local, out of state, and foreign (such as those from the U.S. and Canada) will be required to carry proof of liability insurance while driving.

Wasn't insurance already a requirement in Baja California (Norte)?

Previously, having Mexican insurance or providing proof of financial responsibility (such as cash) was required if you were in an accident. However now the law requires everyone to carry a Mexican liability insurance to prevent being ticketed.

Do all Baja Bound insurance policies fulfill this new requirement?

Yes. All of Baja Bound's policies fulfill the liability requirement.

What is the minimum liability requirement in Baja California (Norte)?

According to the law in Baja California , the minimum liability coverage required to cover other people and their property is approximately $928,247 pesos*, which is about U.S. $46,412 based on an exchange rate of $20.00 (as of June 22, 2021).

(*Found by multiplying the amount of 4,350 according to the law, by the current minimum wage of Baja California Norte of $213.39 pesos).
Is the minimum legal requirement in Baja California (Norte) sufficient coverage?

In our experience, the minimum requirement is not sufficient in some cases. We generally recommend at least $500,000 in third party liabilty, or higher. The lowest limit Baja Bound offers is U.S. $100,000 in third party liability and the highest we offer is U.S. $1,000,000.

Will authorities be able to enforce this law?

This remains to be seen. Before this law was enforced a few Baja Bound customers informed us that authorities have asked them for proof of insurance. This may increase. Many drivers in Mexico unfortunately cannot afford insurance which makes it hard to enforce.
